The provisions stipulated in this Clause only apply to natural persons (hereinafter referred to as Consumers) acting outside their professional or business spheres of activity.
The Consumer is entitled to withdraw from the contract of sale without giving a reason within fourteen (14) days of receiving
a) the product,
b) the last provided product in the case of the sale of a number of products, or if the sale of the individual products happens at different times,
c) in the case of batch or multi-piece products, the last delivered batch or item,
d) if the product is to be delivered regularly within a certain period of time, from the day of receipt of the first service by the Consumer or a person nominated by him other than the shipper. The Consumer is also entitled to the right of withdrawal in the period between the day of signing the contract and the date of the receipt of the product.
If the Consumer wishes to exercise his/her withdrawal/cancellation right, they must send a letter by mail, fax or electronically containing their express declaration of cancellation/withdrawal intent to the Service Provider using one of the contact options of ECO-CRANES HUNGARY KFT. The Consumer exercises their right of withdrawal within the deadline if they send their declaration of withdrawal to the Service Provider before the above deadline. The onus of proof is upon the Consumer to prove that the cancellation/withdrawal rights were exercised in accordance with the legal provisions in force.
In both cases the Service Provider immediately confirms the receipt of the withdrawal/cancellation declaration by email.
A written withdrawal/cancellation must be considered validated if the Consumer sends their statement to this effect within fourteen (14) calendar days (including the 14th calendar day) to the Service Provider.
The Service Provider shall take into account the date of postage if sent by post, or the time of sending the email or fax, if sent by email or telefax, when calculating the deadline. The Consumer should post their letter registered to be able to satisfactorily prove the date of postage.
In the case of cancellation the Consumer is required to return the ordered goods to the address of ECO-CRANES HUNGARY KFT. without undue delay, but no later than fourteen (14) days from the date of notification of the withdrawal intention. The deadline is considered to have been observed if the Consumer returns the goods (mails or hands over to the courier ordered by them) before the expiry of the fourteen (14) day deadline.
The direct cost of returning the product to the address of the Service Provider is to be paid by the Consumer. The Service Provider is not in a position to accept packages sent by payment-on-delivery. The Customer is not charged any cost in connection with the cancellation other than the cost of returning the product.
The Consumers can only be held liable for the diminished value of the product if the damage resulted from the use of the product in excess to determine its nature, characteristics and operation.
If the Consumer cancels the contract, the Service Provider shall refund all remunerations made by the Consumer, including the cost of transportation, within a maximum of fourteen (14) days of receipt of the Consumer’s withdrawal notice, except for the extra costs that arose as a result of the Consumer choosing a transportation method different from the cheapest, customary transportation method offered by the Service Provider. The Service Provider is entitled to withhold the refund until they have received the product, or the Consumer has credibly proven that they have returned it: The Service Provider will consider the earlier date as a point of reference.
In case of withdrawal/cancellation, the Service Provider will refund the amount due to the Consumer by the same payment method as that used by the Consumer, except if the Consumer gives their explicit consent to the use of a different method of payment; no additional cost is charged to the Consumer for this repayment method.
Exceptions to the Consumer’s withdrawal and cancellation rights:
The Consumer may not exercise their right of withdrawal or cancellation concerning the following products sold, or services provided, by the Service Provider:
a) in the case of a contract concerning the provision of a service after the service has been fully performed, if the Service Provider commences the performance of the service at the express request and with the prior consent of the Consumer, and the Consumer agreed that they would lose their right of cancellation after the completion of the service;
b) concerning products or services, the cost or fee of which cannot be influenced by the Service Provider owing to the possible fluctuation of the financial market, even during the 14-day deadline of withdrawal;
c) in the case of non-prefabricated products that the Service Provider has produced according to the instructions or express request of the Consumer, or in the case of products which have been clearly designed specifically for the Consumer;
d) concerning perishable products or those that only keep their quality for a short time;
e) in the case of products in sealed packaging, which cannot be returned after opening, owing to health or hygiene reasons;
f) in respect of a product, which by its nature inseparably mixes with other products following delivery;
g) in the case of a business contract, in which the Service Provider contacts the User at the express request of the Consumer with the purpose of carrying out urgent repairs or maintenance work;
h) concerning the sale of audio or video recordings or copies of computer software in sealed packages, if the consumer has opened the packaging after delivery;
i) concerning digital data content provided on a non-physical data storage device, if the Service Provider initiated the performance of the service at the express prior consent of the Consumer, and with this consent the Consumer declared their cognizance that they would lose their right of withdrawal after the beginning of implementation.
